1About MySemak
MySemak is a community customer-record screening service intended to help users make more informed rental and other legitimate dealing decisions.
MySemak allows registered users to search for community-submitted records using a complete NRIC or passport number and, where permitted, to submit reports based on genuine dealings or direct experiences.
MySemak does not determine whether a person is a "good" or "bad" customer. A search result is not a credit score, risk score, criminal record, government record, legal finding, or guarantee of a person's identity, reliability, financial position, behaviour, or future conduct.
Unless expressly stated otherwise, reports displayed through MySemak are submitted by users and represent the submitting user's account of an experience. MySemak does not adopt or endorse a user's allegation merely because a report is searchable on the service.
2Acceptance of These Terms
By creating an account, accessing protected MySemak functionality, conducting searches, or submitting reports, you agree to these Terms of Use and acknowledge the applicable Privacy Notice.
You must be legally capable of entering into these Terms and must use MySemak only for lawful purposes.
Where MySemak introduces a materially updated version of these Terms, you may be required to review and accept the updated Terms before continuing to use protected functionality.
If you do not agree to the applicable Terms, you must not use the relevant protected functionality.
3Your Account
You must register using an email address that you are authorized to use, complete the required verification process, and keep your password and account access secure.
You are responsible for activity carried out through your account unless you promptly notify MySemak of suspected unauthorized access.
You must not:
- sell, transfer, rent, or improperly share your account;
- create or use accounts to bypass restrictions;
- impersonate another person;
- provide false registration information;
- use another person's account without authorization;
- attempt to re-register using prohibited means after an account has been permanently closed.
MySemak may apply reasonable security, rate-limit, suspension, and anti-abuse measures to protect users, records, and the service.
4Legitimate Use of Search
You may use MySemak only where you have a legitimate reason connected with an actual or reasonably contemplated dealing involving the relevant person.
Searches require a complete NRIC or passport number in the format accepted by the service.
You must not use MySemak to:
- conduct automated or bulk identity searches;
- enumerate identity numbers;
- scrape, harvest, copy, or systematically extract search data;
- build a separate identity database from MySemak results;
- stalk, threaten, harass, shame, discriminate against, or intimidate any person;
- obtain or attempt to obtain private evidence belonging to another report;
- circumvent search limits, access controls, rate limits, or security controls;
- use multiple accounts, shared accounts, scripts, bots, or other methods to defeat abuse protections;
- use the service for an unlawful purpose.
A search result is information for your consideration only. You remain responsible for your own rental, contracting, credit, commercial, or other lawful decision.
5Community Search Results
A search result may indicate that one or more community reports are associated with the searched identifier.
The existence of a report does not mean that MySemak has independently determined every statement in that report to be true.
MySemak may use automated checks, moderation, supporting information, dispute procedures, and other integrity measures, but MySemak cannot guarantee that every report is independently verified before it becomes searchable.
Reports may later be corrected, updated, disputed, resolved, restricted, or removed.
Users should consider the report date, status, last updated information, factual description, and their own independent information before making a decision.
6Submitting a Report
You may submit a report only where it arises from a genuine dealing, transaction, or direct experience connected with the person concerned.
You must provide information that is accurate to the best of your knowledge and must not intentionally or recklessly create a materially misleading impression.
Your report must be factual, proportionate, relevant to the dealing, and limited to information reasonably necessary to describe what happened.
You must not submit a report for:
- revenge;
- harassment;
- intimidation;
- discrimination;
- malicious debt-collection pressure;
- commercial sabotage;
- knowingly false accusations;
- misleading publicity;
- any other improper or unlawful purpose.
7Your Responsibility for Submitted Information
By submitting a report, you represent and confirm that, to the best of your knowledge:
- you had a genuine dealing or direct experience relevant to the report;
- the material facts you provide are accurate;
- the report does not omit information in a way that creates a materially misleading impression;
- you have a reasonable basis for material allegations contained in the report;
- any supporting evidence has not been manipulated in a way that misrepresents what occurred;
- you are authorized to submit the information and evidence for the relevant purpose;
- the report does not unlawfully infringe another person's rights;
- you will cooperate reasonably if MySemak requests clarification concerning a dispute or integrity review;
- you will notify MySemak if you later become aware that a material part of the report is inaccurate or materially incomplete.
You remain responsible for the content you submit through your account.
8Factual Language and Prohibited Content
Public descriptions should describe observable events and relevant facts.
Do not use unnecessary labels about a person's character or criminality as though they were established facts.
You must not publish through MySemak:
- threats or abusive content;
- discriminatory content;
- knowingly false statements;
- malicious accusations;
- unnecessary personal or sensitive information;
- full identity numbers in public descriptions;
- private contact details;
- residential addresses;
- passwords, financial credentials, or security information;
- private evidence belonging to another person without authorization;
- altered or fabricated evidence intended to mislead;
- content prohibited by applicable law.
MySemak may redact, restrict, hide, or remove content that breaches these requirements or creates a material privacy, security, integrity, or legal concern.
9Supporting Evidence
Supporting identity documents, photographs, screenshots, receipts, agreements, or other evidence uploaded with a report are not intended to be publicly accessible to ordinary users unless MySemak expressly provides otherwise for a lawful and appropriate purpose.
You must only upload evidence that you are authorized to provide.
MySemak may use supporting evidence for purposes including:
- report integrity checks;
- moderation;
- dispute investigation;
- abuse prevention;
- account/security investigation;
- establishing the history of a submission;
- responding to lawful requests;
- establishing, exercising, or defending legal claims;
- other purposes described in the Privacy Notice and permitted by applicable law.
Do not attempt to obtain another user's private supporting evidence without authorization.
10Publication and Moderation
A submitted report may become searchable after submission, subject to automated screening, moderation, and integrity controls.
MySemak may, where reasonably appropriate:
- delay publication;
- request clarification or additional supporting information;
- redact unnecessary personal information;
- restrict visibility;
- mark a report as disputed;
- mark a report as resolved;
- correct an obvious error;
- temporarily hide a report;
- remove a report;
- preserve an internal record of moderation and status history.
MySemak is not required to accept every submission for public display.
A moderation decision does not necessarily amount to a finding that either party is legally right or wrong.
11Changes, Resolution, and Reporter Update Duty
Circumstances may change after a report is submitted.
If you submitted a report, you must notify or update MySemak within a reasonable period after becoming aware of a material development that could affect how the report should be understood.
Examples may include:
- a previously unpaid amount being paid;
- property being returned;
- repair or damage being settled;
- the parties reaching a settlement;
- a complaint being withdrawn;
- an authority or court making a relevant determination;
- discovering that information previously submitted was materially inaccurate.
MySemak may display status and last-updated information to give users better context.
Marking a matter as resolved does not necessarily erase the historical existence of the report.
12Corrections and Disputes
A reporter, affected person, or other person with a legitimate basis may request review of a report through MySemak's designated support or dispute channel.
A dispute request may require information reasonably necessary to identify the relevant report and assess the request, such as:
- report reference;
- account information where applicable;
- confirmation of identity where reasonably required for the review;
- identification of the disputed statement;
- explanation of why it is inaccurate, incomplete, unauthorized, or misleading;
- supporting information.
Submitting a dispute does not automatically require MySemak to remove a report.
During or after a review, MySemak may:
- maintain the report;
- add or change a dispute/status indicator;
- request further information;
- redact information;
- correct information;
- restrict visibility;
- temporarily hide the report;
- remove the report.
Do not publish or circulate another user's private evidence as part of a public dispute.
MySemak may decline abusive, repetitive, fraudulent, or unsupported requests while preserving appropriate escalation for genuine disputes.
13Abuse Controls and Account Restrictions
MySemak may monitor for patterns reasonably associated with scraping, identity enumeration, automated searching, account sharing, access-control circumvention, malicious reporting, or other misuse.
Confirmed abuse may result in:
- a temporary restriction;
- a longer restriction for repeated confirmed abuse;
- permanent account closure for serious or repeated abuse;
- blocking the relevant email from future registration where appropriate;
- removal or restriction of abusive content;
- other reasonable protective measures.
Ordinary typing mistakes should not automatically be treated as confirmed abuse.
Administrators may investigate and correct false-positive restrictions.
Permanent account closure does not automatically require deletion of otherwise valid historical reports submitted before closure.
14Privacy and Personal Data
MySemak processes personal data in connection with account registration, searches, reports, supporting evidence, security, moderation, disputes, service operation, and other legitimate purposes described in the applicable Privacy Notice.
Full NRIC or passport numbers are not intended to be publicly displayed to ordinary users merely because an identifier is used for matching/search.
Users must not use MySemak to unlawfully collect, republish, or disclose another person's personal data.
The Privacy Notice explains the applicable data-handling practices in more detail and forms an important part of your understanding of how the service operates.
15Security and Preservation of Records
MySemak may retain report records, evidence, moderation history, account-security information, acceptance records, and relevant audit logs where reasonably required for:
- operation of the service;
- integrity and abuse prevention;
- dispute handling;
- security investigation;
- record-history preservation;
- applicable retention requirements;
- legal compliance;
- establishing, exercising, or defending legal claims.
Retention and deletion will be handled in accordance with the applicable Privacy Notice, internal retention rules, and applicable law.
You must not attempt to bypass MySemak security controls or gain unauthorized access to systems, accounts, records, or evidence.
16Intellectual Property and Permission to Process Submitted Content
You retain any rights you lawfully hold in content you submit.
By submitting content to MySemak, you grant MySemak a non-exclusive permission, for as long as reasonably necessary, to host, store, reproduce, process, redact, display where appropriate, moderate, review, and otherwise use that content to operate MySemak, administer reports and disputes, maintain security and integrity, and comply with applicable legal obligations.
This permission does not transfer ownership of your original content to MySemak.
You must not upload material where you do not have the necessary right or authorization to provide it.
17Service Availability and Changes
MySemak may update, improve, restrict, suspend, or discontinue features where reasonably required for operational, security, legal, commercial, or technical reasons.
MySemak does not guarantee uninterrupted or error-free availability.
Temporary unavailability, delayed processing, maintenance, provider outages, or security controls should not be interpreted as a successful search result or a statement about the person searched.
18No Guarantee and User Decision Responsibility
MySemak provides community information to assist a user's own enquiries.
To the maximum extent permitted by applicable law, MySemak does not guarantee:
- the accuracy or completeness of every user-submitted report;
- that all relevant incidents have been reported;
- that a person identified in a historical report will behave in the same way in the future;
- that a person with no search result presents no risk;
- the financial capacity, reliability, character, or legal status of any person;
- any particular commercial outcome.
You remain responsible for conducting any other checks appropriate to your transaction and for making your own final decision.
19Limitation of Liability
To the maximum extent permitted by applicable law, MySemak and its operator will not be liable solely because a user chooses to enter into, refuse, continue, terminate, or modify a transaction based on a MySemak search result.
MySemak is not responsible for losses caused by a user's unlawful use of the service, unauthorized disclosure of information, circumvention of security controls, or reliance on a search result as though it were a guarantee.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited.
20User Indemnity for Misuse and Unlawful Submissions
To the extent permitted by applicable law, you agree to be responsible for losses, liabilities, claims, and reasonable costs suffered by MySemak or its operator to the extent they arise from:
- your knowingly false or materially misleading submission;
- your unlawful content;
- your unauthorized disclosure of another person's data or material;
- your infringement of third-party rights;
- your malicious or abusive use of MySemak;
- your material breach of these Terms.
This section does not make you responsible for losses caused by MySemak's own conduct where liability cannot lawfully be transferred to you.
21Lawful Requests and Legal Claims
MySemak may preserve, use, or disclose information where reasonably necessary and permitted or required by applicable law, including in response to a valid legal process, court order, lawful request by a competent authority, or for the establishment, exercise, or defence of legal claims.
MySemak will handle such matters subject to applicable law and its data-protection obligations.
22Suspension and Termination
MySemak may suspend, restrict, or close an account where reasonably necessary because of:
- serious or repeated breach of these Terms;
- abusive searching;
- scraping or automation;
- malicious or fabricated reporting;
- account compromise;
- security risk;
- unlawful activity;
- attempts to circumvent restrictions;
- other material misuse.
Where appropriate, MySemak may preserve relevant records after account closure in accordance with its Privacy Notice, retention rules, dispute obligations, and applicable law.
Closing an account does not automatically erase valid historical records or resolve outstanding disputes.
23Changes to These Terms
MySemak may update these Terms to reflect product changes, security requirements, operational changes, legal requirements, or improved safeguards.
The current version and effective date should be displayed on the Terms page.
Where an update is material, MySemak may require registered users to accept the revised Terms before continuing to use protected functionality.
24Governing Law
These Terms are governed by the laws of Malaysia.
Subject to applicable law, disputes concerning these Terms are subject to the jurisdiction of the courts of Malaysia.
25Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
